Using Farrly
Terms of service
These terms govern access to Farrly's website and platform. Booking-specific information and provider agreements may add to these terms.
Last updated: 4 November 2026
1. About these terms
Farrly is the trading name of Farrer Group Ltd, a company registered in England and Wales under company number 17561309. These terms form an agreement between you and Farrer Group Ltd when you access the Farrly website or platform.
“Farrly”, “we”, “us” and “our” mean Farrer Group Ltd. “Provider” means a childcare business using Farrly. “Platform” means Farrly's websites, applications and related services.
If you use Farrly for a Provider, you confirm that you are authorised to accept these terms and act for that Provider. A separate order, service agreement, pilot agreement or data processing agreement may also apply. If there is a conflict, the more specific agreement governs that subject.
A childcare booking may also have a booking summary and Provider policies shown before confirmation. Those booking-specific terms govern the childcare contract and do not silently change these general platform terms.
2. Accounts and authority
You must be at least 18 and legally able to enter into these terms. Accounts are personal to the registered user. You must:
- provide accurate information and keep it up to date;
- keep credentials and access links secure and not share them;
- use only the organisation, site, child and financial records you are authorised to access;
- tell us or the relevant Provider promptly about suspected unauthorised access; and
- ensure that information you enter is lawful, relevant and appropriate for the Platform.
Providers control their staff membership, site assignments and operational permissions. Parents and carers receive access only through the account and child-linking processes supported by Farrly.
3. Farrly's and providers' roles
Farrly supplies the Platform. The Provider supplies and is responsible for childcare services, including registration, staffing, safeguarding, supervision, attendance decisions, collection procedures, insurance, complaints and regulatory obligations.
Farrly does not employ Provider staff, supervise children, approve a Provider's regulatory status or make safeguarding decisions for the Provider. A booking is not evidence that a child attended, and scheduled times do not replace the Provider's actual handover and attendance records.
Providers are responsible for the accuracy and lawfulness of the content, availability, prices and policies they publish through Farrly. Users should raise childcare quality, staff, attendance and safeguarding concerns with the Provider, without delaying any emergency or regulatory report.
4. Bookings, prices and payments
The Provider identified before confirmation supplies the childcare. Unless the booking summary clearly says otherwise, the childcare contract is between the parent or carer making the booking and that Provider; Farrly is not the childcare provider.
Before confirming a booking, review the Provider, child, site, service, date, scheduled times, total price and applicable Provider policies. A booking is formed only when the Platform confirms it. If the outcome is uncertain, check the booking list before trying again.
Where online payment is enabled, Stripe processes payment for the Provider through the Provider's connected Stripe account. The Provider is the merchant and payment recipient. Farrly may receive a fee from the Provider, but Farrly does not store full card details or hold the gross booking payment for later release to the Provider.
The cancellation policy captured for a booking governs the ordinary contractual outcome, subject to mandatory rights. A later policy change does not retrospectively worsen an existing booking. A credit shown on a Farrly account is not the same as a cash refund. Refund timing may depend on Stripe and the relevant bank.
Provider subscriptions, commissions and other business charges are governed by the Provider's selected plan and any separate agreement or order.
5. Acceptable use
You must not:
- access or attempt to access an account, record, organisation or feature without authority;
- circumvent permissions, security controls, rate limits or technical restrictions;
- upload malicious code, probe for vulnerabilities or disrupt the Platform;
- use Farrly for fraud, unlawful activity, harassment or infringement of another person's rights;
- scrape, bulk extract, reverse engineer or copy the Platform except where the law does not allow that restriction; or
- submit information you do not have the right to use or disclose.
Providers must give users only the access they need, remove access promptly when roles change and use the Platform consistently with data protection and safeguarding duties.
6. Content and intellectual property
You and Providers retain ownership of information and content submitted to Farrly. You grant us the limited rights needed to host, copy, secure, back up, display and otherwise process that content to operate the Platform and meet our legal obligations.
Farrly and its licensors own the Platform, software, design, branding and documentation. Except for the limited right to use the Platform under these terms, no intellectual property rights are transferred to you.
Product descriptions, previews and general website information are provided to explain Farrly. They are not professional legal, accounting, regulatory or safeguarding advice.
7. Privacy
Our privacy policy explains how Farrly uses personal information. Providers have separate responsibilities for the child, family, booking and attendance records they control and must give individuals appropriate privacy information.
8. Availability and changes
We use reasonable care and skill in providing the Platform, but do not promise that it will always be uninterrupted or error-free. Maintenance, security work, supplier failures and events outside reasonable control may affect availability. Providers should maintain workable procedures for time-critical childcare and safeguarding activity if the Platform is unavailable.
We may change the Platform to improve it, maintain security, comply with law or reflect operational needs. We will give reasonable notice of a material reduction where practicable. General Platform changes do not alter the price, service or cancellation terms already captured for a confirmed childcare booking.
9. Third-party services and links
Farrly uses third-party services, including Stripe for payment processing. Their own terms and privacy information may apply to their services. We are not responsible for third-party websites merely because Farrly links to them, but this does not affect responsibility we cannot lawfully exclude for our own acts or omissions.
10. Responsibility and liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these terms affects mandatory consumer rights.
Farrly is responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for childcare supplied by a Provider, Provider content or decisions, or loss caused by information or instructions supplied by a user or Provider.
If you use Farrly for business purposes, we are not liable under these general terms for loss of profit, revenue, business, anticipated savings, goodwill or indirect or consequential loss. Any separate Provider agreement may contain more specific liability provisions.
You are responsible for reasonable steps to reduce avoidable loss, including keeping account access secure, checking booking confirmations and using offline continuity procedures for time-critical operations.
11. Suspension and ending access
You may stop using Farrly at any time, subject to any Provider agreement and outstanding bookings or charges. Providers can ask us to close their service in accordance with their agreement.
We may proportionately restrict or suspend access where reasonably necessary for security, fraud prevention, safeguarding, legal compliance, non-payment or a material breach of these terms. Where appropriate, we will explain the reason and give an opportunity to remedy the issue.
Ending Platform access does not automatically cancel confirmed childcare bookings or remove payment, refund, dispute, record-retention or other accrued obligations.
12. Changes to these terms
We may update these terms to reflect service, legal or operational changes. We will publish the new version and its effective date, and give reasonable notice of material changes. Changes apply prospectively and do not rewrite the terms of an existing confirmed booking.
13. Governing law and contact
These terms are governed by the law of England and Wales. If you are a consumer, you retain any mandatory right to bring proceedings in the part of the UK where you live. If you use Farrly for business, the courts of England and Wales have exclusive jurisdiction, subject to any separate Provider agreement.
If any provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a right does not waive it. No person other than you and Farrer Group Ltd has a right to enforce these general terms.
